Court order pauses new I-539 and I-765 editions tied to student/exchange visitor rule

USCIS says it will keep accepting the 08/28/24 Form I-539 and 08/21/25 Form I-765, and is not accepting the 09/15/26 editions, after a Sept. 14, 2026 federal court order postponed DHS’s final rule for F, J and I nonimmigrants.

A federal court order on Sept. 14, 2026 postponed the effective date of DHS’s final rule on fixed admission periods for F, J and I nonimmigrants. USCIS updated its Form I-539 and Form I-765 pages on Sept. 15, 2026 to say DHS is preliminarily enjoined from implementing the rule, USCIS will proceed under the previous regulatory provisions, USCIS continues to accept the 08/28/24 edition of Form I-539 and the 08/21/25 edition of Form I-765, and USCIS is not accepting the 09/15/26 editions of those forms.
