Form I-751 Comment Window Open: USCIS Takes Feedback Through Oct. 14, 2026

USCIS opened a 30-day Federal Register comment window on the Form I-751 information collection. Comments are due Oct. 14, 2026.

USCIS published a 30-day Federal Register notice for the Petition to Remove the Conditions on Residence, also known as Form I-751. The notice (document 2026-18736, published Sept. 14, 2026) says comments are encouraged and will be accepted until Oct. 14, 2026.

What this notice is

Plain English: this is an information-collection review under the Paperwork Reduction Act. It covers the form, the instructions, the public burden estimate, and public comments on them. It is not a new immigration eligibility rule and it is not individual case guidance.

Who Form I-751 concerns

USCIS says Form I-751 is filed by conditional permanent residents who obtained that status through marriage to a U.S. citizen or lawful permanent resident, or through a parent’s marriage, to ask USCIS to remove the conditions on their residence.

How to comment

The notice directs comments through Regulations.gov under docket USCIS-2009-0008 and asks commenters to reference OMB control number 1615-0038. The direct comment link for this notice is regulations.gov/commenton/USCIS-2009-0008-0088.

USCIS also warns that comments are posted publicly and may include personal information the commenter provides, so it is worth removing case numbers, receipt numbers, and other personal details before submitting.

What this does not change

  • It does not change the filing requirements or fees for Form I-751 by itself.
  • It does not extend any individual filing deadline.
  • It does not change how USCIS decides a pending or future I-751.

Conditional residents with questions about their own two-year window, joint filing, or a waiver request should speak with a licensed immigration attorney or a DOJ-accredited representative.
